Press Statement by Teoh Beng Hock Trust for Democracy on 21 June 2016


Teoh Beng Hock Trust for Democracy (“TBH Trust”) applauds the decision of the Court of Appeal which ruled that negligence by the Malaysian Anti-Corruption Commission had led to the death of Selangor Customs assistant director Ahmad Sarbaini Mohamed in 2010 and awarded a total of RM213,000 in damages to his family.

TBH Trust in its press statement said that the irresponsible public institution and those officers involved must be held accountable for two consecutive deaths in its premises in 2009 and 2010, that is, Teoh Beng Hock and Ahmad Sarbaini.

However, TBH Trust note with regret that neither any of the top officials of MACC took responsibility of causing the deaths by tendering resignations nor make public apologies The image of the anti corruption institution is marred for repeated human rights violations since it’s establishment.

Justice for Ahmad Sarbaini and Teoh Beng Hock should not end with monetary compensation only, the police and attorney general should pursue criminal responsibility of those responsible in MACC. TBH Trust urge the government to initiate prosecution against the MACC officers who were involved in causing the death of Ahmad Sarbani for culpable homide under section 304a of the Penal Code.

Similarly, those officers involved in Teoh Beng Hock’s death must also be charged and punished.
