From three MACC extensions to the NFCC Advisory Board: What makes Azam Baki so indispensable?
The Teoh Beng Hock Association for Democratic Advancement strongly objects to the appointment of former Malaysian Anti-Corruption Commission chief commissioner Azam Baki as a member of the Advisory Board of the National Anti-Financial Crime Centre (NFCC), and urges Prime Minister Anwar Ibrahim to immediately revoke the appointment.
Section 5(6) of the National Anti-Financial Crime Centre Act states that, in advising the Yang di-Pertuan Agong on the appointment of the Chair and members of the NFCC Advisory Board, the Prime Minister must take into account the person’s probity and standing; academic qualifications, knowledge, skills and experience in areas such as banking, economics, finance, asset management, taxation, prosecution, investigation and law; as well as the likelihood of any conflict between the interests of the NFCC and any interest the person has or represents.
Prime Minister Anwar must explain how this appointment meets the legal requirements relating to probity, standing and conflict of interest.
Under Section 9 of the Act, the Advisory Board is tasked with advising the Prime Minister on matters relating to financial crime, advising the NFCC on its strategic direction and plans, deliberating and deciding on recommendations made by the Executive Committee on financial crime matters, and facilitating cooperation between the NFCC, government entities and enforcement agencies for the prevention of financial crime.
Azam Baki had his contract as MACC chief commissioner extended three times. During his tenure, he was embroiled in controversies involving share ownership, abuse of power, criminal intimidation and the “corporate mafia” allegations. Yet after stepping down, he has now been appointed to the NFCC Advisory Board.
The government must explain what makes Azam Baki so indispensable that the Anwar administration is willing to keep him within the national anti-corruption and financial crime prevention system, even before major public integrity concerns have been clarified, before a Royal Commission of Inquiry has been established, and before independent accountability has been completed.
In view of this, the Teoh Beng Hock Association for Democratic Advancement makes two demands:
First, Prime Minister Anwar must immediately revoke Azam Baki’s appointment to the NFCC Advisory Board.
Second, the government must respond to the demands of the RCI Now Secretariat and civil society by establishing a Royal Commission of Inquiry to thoroughly investigate the “corporate mafia” controversy and related allegations involving the MACC’s top leadership.
Anwar has long made anti-corruption, reform and good governance central to his political commitments. If he allows a former MACC chief commissioner who remains the subject of serious public controversy to enter the NFCC Advisory Board, it will severely undermine the credibility of the government’s reform agenda.

三度延任后再入NFCC顾问团 阿占究竟有何不可取代
赵明福民主促进会严正反对前反贪会主席阿占巴基受委为国家金融犯罪预防中心(NFCC)顾问团成员,并促请首相安华立即撤销有关委任。
《国家金融犯罪预防中心法令》第5(6)条明确规定,首相在建议国家元首委任NFCC顾问团时,必须考虑人选的诚信声望、相关学历、知识、技能与经验,以及是否可能与NFCC的利益产生冲突。
首相安华必须解释,这项委任如何符合法令对诚信声望和利益冲突的要求。
根据该法令第9条,NFCC顾问团的职权包括向首相就金融犯罪事务提供意见、向NFCC提供策略方向与计划建议、审议并决定执委会提出的金融犯罪相关建议,及促进NFCC、政府和执法机构之间的合作。
阿占巴基曾三度获得反贪会主席合约延任,并在任内卷入持股、滥权、刑事恐吓和“企业黑帮”相关争议,如今卸任后又被列入NFCC顾问团。政府必须说明,阿占巴基究竟有何不可取代之处,足以让安华政府在重大公共诚信争议尚未厘清、皇家调查委员会尚未成立、独立问责尚未完成前,继续让他留在国家反贪与金融犯罪防范体系之内?
对此,赵明福民主促进会提出两项要求:
第一,首相安华必须立即撤销阿占巴基的NFCC顾问委任。
第二,政府必须回应RCI Now秘书处及公民社会的诉求,成立皇家调查委员会,彻查“企业黑帮”争议及反贪会高层相关指控。
安华长期以反贪、改革和良好治理作为政治承诺。如今,若他允许一名仍面对重大公共争议的前反贪会主席进入NFCC顾问团,将严重削弱政府改革承诺的诚信。
