#Tangkapazambaki rally and 50 CSO joint statement 逮捕阿占巴基集会与50公民组织联署文告

Representatives of Teoh Beng Hock Trust for Democracy and friends attended the #tangkapazambaki rally on 22 Jan 2022. We emphasize that the core issue with the Malaysian Anti-Corruption Commission is the culture of impunity, which allows killings, tortures and corruption to happen. MACC can only be reformed by eliminating the culture of impunity.

Below is the joint statement issued by 50 civil society organizations including Teoh Beng Hock Trust for Democracy on 12 Jan 2022.

赵明福民主基金会代表和朋友今天出席了#逮捕阿占巴基的抗议集会。我们强调,反贪会首席专员拥有大量可疑股票的风波,其关键问题在于反贪会长久以来被政府容许的免责文化。此免责文化导致反贪会发生致死和折磨被扣留者,以及贪腐事件。改革反贪会必须根除免责文化。

下面是今年1月22日马来西亚50个公民社会组织针对阿占巴基风波发出的联署文告。赵明福民主基金会是联署单位之一。

Respons kumpulan masyarakat sivil terhadap krisis SPRM

[ENGLISH VERSION BELOW] Melihat kepada kontroversi semasa melibatkan pemilikan saham menggunakan nama ketua pesuruhjaya Suruhanjaya Pencegah Rasuah Malaysia, Azam Baki, kami, organisasi sivil yang menandatangani ini menuntut:

1. Bahawasanya kuasa dipunyai oleh Perdana Menteri Ismail Sabri Yaakob untuk memulakan penyiasatan bebas bagi mengembalikan kredibiliti SPRM

2. Supaya pihak berkuasa menuntut beberapa individu/entiti untuk menjawab persoalan penting, khususnya:

a) Bagaimanakah ketua pesuruhanjaya SPRM membenarkan adiknya untuk membeli saham menggunakan akaun peribadinya walhal ia boleh jadi salahguna mengikut Akta Perindustrian Sekuriti (Depositori Pusat) 1991?

b) Mengapakah pengerusi lembaga penasihat SPRM didakwa mengetepikan pandangan anggota lain di dalam lembaga pengarah dan bergantung kepada pandangannya sendiri bagi membebaskan Azam Baki?

c) Mengapakah anggota lain lembaga penasihat hanya berdiam diri berkaitan rungutan yang diutarakan oleh Dr Terence Gomez selepas mereka mengikut mesyuarat pada 24 November untuk membincangkan hal ini.

3. Agar Lembaga Penasihat SPRM untuk mengeluarkan minit mesyuarat pada 24 November untuk menunjukkan atas dasar apa Azam Baki dibebaskan tanpa melalui proses penyiasatan yang sepatutnya

4. Supaya Azam Baki bercuti sehingga penyiasatan selesai

5. Agar Azam Baki menarik balik surat tuntutan terhadap pemberi maklumat, dan reformasi terhadap Akta Perlindungan Pemberi Maklumat dijalankan bagi memperkukuh perlindungan melibatkan pemberi maklumat

6. Supaya pihak kerajaan dapat menjalankan reformasi secara serius agar SPRM bebas, seperti yang digariskan oleh empat kumpulan pada tahun 2015

7. Agar SPRM dikeluarkan dari Jabatan Perdana Menteri dan diletakkan di bawah seliaan jawatankuasa terpilih khas rentas parti parlimen

Civil society groups respond to MACC crisis

Given the current controversy over the shareholdings in MACC chief Azam Baki’s name, we, the undersigned civil society organisations, demand

1. that the authorities headed by Prime Minister Ismail Sabri Yaakob put in motion a much-needed independent investigation to restore the credibility of the MACC

2. that the authorities demand that the following individuals/entities be made to answer pertinent questions, in particular:

a) How could the MACC chief have allowed his brother to buy shares on his securities account when it could be a violation of the Security Industry (Central Depositories) Act?

b) Why did the MACC advisory board chairperson allegedly disregard the views of the other members of the advisory board and rely on his personal opinion to exonerate Azam Baki?

c) Why did the other members of the advisory board remain silent about the complaints raised by Dr Terence Gomez after they attended a meeting on 24 November to discuss them?

3. that the MACC advisory board releases the minutes of its 24 November to show on what basis it exonerated Azam Baki without a proper investigation

4. that Azam Baki goes on leave pending the outcome of the investigation

5. that Azam Baki withdraws the letter of demand against the whistleblower and that reforms to the Whistleblowers Protection Act be undertaken to strengthen the protection of whistleblowers

6. that the government implements serious reforms to make the MACC independent, along the lines recommended by four groups in 2015

7. that the MACC be removed from the Prime Minister’s Department and be placed under the oversight of a bipartisan parliamentary special select committee
