Torture Victim Anwar Ignores Torture Once More: MACC Reform Must Be Placed on the Immediate Agenda
The Teoh Beng Hock Association for Democratic Advancement (TBHADA) expresses its shock and extreme regret regarding Prime Minister Anwar Ibrahim’s recent remarks concerning Bloomberg’s expose on alleged abuses of power by the Malaysian Anti-Corruption Commission (MACC). The Prime Minister’s decision to offer unreserved support for the MACC despite these surfacing allegations is not only a desecration of the spirit of the rule of law but a blatant betrayal of human rights values.
The Bloomberg investigation uncovered a chilling underworld: it is alleged that the MACC has been reduced to acting as enforcers for rogue corporations, using the guise of investigation to suppress target companies. Through various methods of psychological torture, pressure was reportedly exerted on business owners to relinquish their ownership. Even more revolting are the allegations suggesting that the shares held by MACC Chief Commissioner Azam Baki are linked to these chains of interest.
As the nation’s highest anti-corruption body, the MACC is now embroiled in a severe crisis of integrity involving the use of public power to plunder private property. The Prime Minister’s blind defense of the agency is tantamount to condoning corruption and bullying.
We must remind Prime Minister Anwar Ibrahim that he was once one of the most tragic victims of enforcement violence. The history of him being beaten into a black eye by the then-Inspector General of Police while in custody remains an indelible stain on Malaysia’s human rights record.
As a political leader who has personally experienced torture and who brands himself a reformist, Anwar should, above all others, empathize with the helplessness of detainees. Yet, instead of ordering a thorough investigation into the allegations of human rights violations by the MACC, he has chosen to fully endorse the agency. This transformation is chilling—has power truly caused him to forget the pain that once cut so deep?
The MACC has long enjoyed a state-protected culture of impunity, never having to account for its own failures:
• Teoh Beng Hock and Ahmad Sarbani died at the MACC offices, yet to this day, no officials have been brought to justice.
• The disappearance of individuals like Pamela Ling remains an issue where enforcement agencies still owe the public an explanation.
• 47 cases of alleged torture by the MACC were reported, but police investigations led to no further action.
If the government continues to allow the MACC to operate without oversight or punishments, similar tragedies will only continue to recur.
TBHADA urges the Unity Government to place MACC reform on the emergency agenda:
1. Investigation and Accountability: Conduct a thorough investigation into the Bloomberg allegations and all past cases of death and torture. Prosecute all MACC officers who have abused their power or broken the law.
2. Amend Section 30 of the MACC Act: Explicitly mandate that interrogation hours be limited to 9:00 AM to 5:00 PM, strictly prohibiting overnight interrogations and psychological torture.
3. Guarantee Basic Human Rights for Detainees: Ensure detainees have the right to legal representation (presence of a lawyer), the right to immediate contact with family, and access to essential medication, food, and hygienic detention environments.
We call on the Anwar administration to stop the political rhetoric and take concrete action to end the culture of torture within enforcement agencies. If the so-called “Malaysia Madani” comes at the cost of sacrificing human rights and condoning abuse of power, how is it any different from the corrupt regimes of the past?

酷刑受害者安华再次漠视酷刑 改革反贪会必须马上提上议程
赵明福民主促进会对首安华近期针对彭博社(Bloomberg)揭露反贪会(MACC)涉嫌滥权一事所发表的言论,深表震惊与极度遗憾。首相在相关指控浮出水面后,依然选择毫无保留地支持反贪会,这不仅是对法治精神的亵渎,更是对人权价值的公然背弃。
彭博社的调查揭露了令人毛骨悚然的黑幕:反贪会疑似沦为流氓企业的打手,利用调查之名行打压之实。通过各种精神折磨手段,施压企业拥有人放弃公司所有权。更令人发指的是,指控显示反贪会主席阿占巴基所持有的股票,竟与这些利益链条有所牵连。
作为反腐败的最高机构,反贪会如今却陷入了利用公权力掠夺私产的严重诚信危机,首相的盲目护航,无异于在纵容贪腐与霸凌。
我们必须提醒首相安华,他曾是执法暴力最惨痛的受害者。当年他在被扣留期间,遭时任全国总警长殴打成黑眼圈的历史,是大马人权史上无法磨灭的污点。
作为一名亲历过酷刑、自许为改革分子的政治领袖,安华理应最能感同身受被扣留者的无助。然而,他如今不但没有下令彻查反贪会侵犯人权的指控,反而全力为该机构背书。这种转变令人心寒,难道权力真的会让人遗忘曾经切肤的伤痛吗?
反贪会长期以来享有国家庇护的免责文化,无需为自身的过失负责:
• 赵明福与阿末沙巴尼死在反贪会总部,至今没有官员被绳之以法;
• 林芫的失踪案,执法机关依然欠公众一个交代。
• 曾经投诉反贪会施加酷刑的47宗案件,警方调查后都不了了之。
如果政府继续允许反贪会在缺乏监督和处罚的情况下运作,类似的悲剧只会不断重演。
赵明福民主促进会促团结政府将改革反贪会提上紧急议程:
1. 彻查与问责: 彻查彭博社的指控和过去所有的命案和酷刑案件,依法查办所有滥权违法的反贪会官员。
2. 修改《反贪会法令》第30条: 明文规定盘问时间必须限制在早上9点至下午5点,严禁通宵盘问和精神折磨。
3. 保障被扣留者基本人权: 必须确保被扣留者享有法律代表权(律师陪同);即时联络家人的权利;获取基本药物、饮食及符合卫生标准的扣留环境。
我们呼吁安华政府停止政治修辞,采取实际行动终结执法机关的酷刑文化。如果所谓的“昌明大马”是以牺牲人权和纵容滥权为代价,那它与前朝腐败政权又有何异?
